NHS pays £13 million after botched births left siblings with cerebral palsy

After a two-decade legal fight the health service has finally agreed to pay compensation to a family left devastated by medical negligency

A mother has won a £13 million legal battle against the NHS after hospital blunders 17 months apart left two of her children with cerebral palsy. Paula McKay was left devastated in 1991 when daughter Natasha was born severely disabled after she was starved of oxygen during her birth at the former Sharoe Green Hospital in Preston in Lancashire. But just 17 months later her son Patrick suffered a similar botched delivery which left him needing constant care. It was months before doctors admitted there was a problem, telling his mother he was simply a ‘lazy little boy.’

Now after a legal fight lasting more than two decades Mrs McKay’s has been awarded a multi-million pay-out on behalf of her children. She is believed to be the first person to be the victim of two such catastrophic errors, made by the same hospital maternity team.

£1m state payout for ‘blacklist’ care staff

Nurses and care home workers accused of abusing or endangering elderly residents have been paid £1 million in Government compensation, after judges ruled that their human rights had been breached.
Sixty nurses and care staff received out-of-court settlements worth a total of £1,062,005, including legal costs, last year, equating to £17,700 each.
The compensation was paid after they were automatically placed on a “blacklist” banning them from working with vulnerable adults as soon as allegations of misconduct against them were made.
The most senior judges in the country ruled that the blacklisting procedure broke human rights law by denying nurses the right to a fair hearing before suspending them without pay for months, forcing some to sell their homes

Negligence-case lawyers ‘look for too much money’

THE parents of children brain damaged at birth are enduring long court ordeals because their lawyers are asking for exorbitant compensation, according to the head of the State Claims Agency.
Ciaran Breen was responding to strong criticism levelled at the agency for its treatment of families who have taken medical negligence claims against hospitals and doctors for their child’s catastrophic injury.
“Many people express concern that, in some cases, parents of children who have been catastrophically injured as a result of clinical negligence have had to undergo the additional trauma of giving evidence in court and being cross-examined on their evidence,” he said.
“Sometimes it happens because the case is so complex that liability or causation have been difficult to determine or are in dispute.
“But it mostly happens in cases where the settlement demands made by plaintiffs’ lawyers are significantly overstated.”
